Refugee status and protection may be offered by Canada to a foreign individual who is already in Canada because of a fear of persecution. This can allow the individual to live and work in Canada as a permanent resident and seek safety from persecution — for example, where returning to their home country would expose them to torture, risk to life, or cruel and unusual treatment or punishment.

What Refugee Protection Means

Refugee status offers safety to people who cannot safely return home. Once recognized, an individual may live and work in Canada as a permanent resident, protected from the persecution they fled.

Who Can Make a Refugee Claim

To make a refugee claim, you must be in Canada and cannot be under a removal order. Your eligibility for refugee status will be determined by the Immigration and Refugee Board of Canada.

Eligibility

There are two categories of refugee status, and the Refugee Status Determination is made by the Immigration and Refugee Board of Canada:

  • Convention Refugee — an individual who is outside of their home country and cannot return because of a well-founded fear of persecution based on:
    • Race
    • Religion
    • Political opinion
    • Nationality
    • Being part of a particular social group (such as the 2SLGBTQ+ community)
  • Person in Need of Protection — an individual who is in Canada and cannot safely return to their home country because of:
    • Danger of torture
    • Risk to life
    • Risk of cruel and unusual treatment or punishment
